Welcome to our website. By using this website, you agree to be bound by these terms and conditions. Please read them carefully before placing an order. These terms and conditions outline the rules and regulations for the use of KayTeko’s Website, located at www.kayteko.co.za.

By accessing this website we assume you accept these terms and conditions. Do not continue to use KayTeko if you do not agree to take all of the terms and conditions stated on this page.

The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and all Agreements: “Client”, “You” and “Your” refers to you, the person log on this website and compliant to the Company’s terms and conditions. “The Company”, “Ourselves”, “We”, “Our” and “Us”, refers to our Company. “Party”, “Parties”, or “Us”, refers to both the Client and ourselves. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner for the express purpose of meeting the Client’s needs in respect of provision of the Company’s stated services, in accordance with and subject to, prevailing law of South Africa. Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to same.

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms and Conditions without written notice to users of the Website. Your continued use of, or access to, our Website following the posting of any changes to these Terms and Conditions constitutes acceptance of those changes. The responsibility lies with you to read these Terms and Conditions for any changes.

Products

All our products are made to order. This means that we only commence the process of producing the garment once payment has been received. A maximum of 14 days should be given between the day when the order was paid for and accepted by us and the day is order is shipped from our studio. Note that due to the ongoing and unexpected changes in loadshedding and its stages, we cannot guarantee that we will complete your garment within these 14 days but we will do our outmost best to keep to this timeframe while communicating to you any delays due to loadshedding. Since all of our garments are either made-to-order, made-to-measure or bespoke pieces, we do not offer refunds on pieces due to the delay caused by loadshedding.

Should we not be able to commence or continue with the production of the garment that you ordered directly from this website for any reason specific to our processes, you are entitled to a KayTeko coupon to the value of your original order that can be used at any time on any product on the website or a custom piece, or you can request a full refund to the value of the original order. We are unable to accommodate requests for a combination of both.

Please note that due to the nature of made-to-order products, there may be slight variations in colour, texture, design and fit from the images and descriptions on our website. These variations are not considered defects and do not affect the quality or functionality of the products.

Prices

The prices of our products are displayed on our website and are subject to change at any time without notice. The prices do not include delivery charges, taxes or duties, which will be added to your total order amount at checkout unless otherwise stated.

We try to ensure that all prices on our website are accurate, but errors may occur. If we discover an error in the price of any product you have ordered, we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you, we will treat the order as cancelled and refund you in full.

Purchases and Payment

All items sold on KayTeko are reflected in South African Rands (ZAR) and are subject to change without notice.

For garments ordered and paid for through the website, you can pay for your order using any of the payment methods available on our website. We accept most major credit cards and debit cards and  is facilitated using Yoco’s services as a payment platform. We will not process your order until we receive full payment. We use secure payment systems to protect your payment information from unauthorised access or fraud. However, we cannot guarantee the security of any data transmitted over the internet and we are not liable for any loss or damage that may result from such transmission.

For made-to-measure or custom garments, a non-refundable 25% deposit is required before work commences, the final balance is payable upon completion. Payment must be received before, or on, the day of collection (if collection is in person) or the day prior to the garment being dropped off at couriers (if courier option is chosen), either by cash or debit card payment. Payments can also be paid monthly until the balance is cleared otherwise the items will not be released to the customer. Please send proof of payment to orders@kayteko.co.za and use the invoice number as the reference.

Orders and Deliveries

An order is only complete once successful payment has been made, at which point KayTeko reserves the right to accept or reject the order at our discretion, as well as produce, package and ship the order to the customer. 

After we have confirmed receipt of payment for an item sold on the website, allow a maximum of 14 business days following the day after the successful payment was made for your order to be shipped. 

Pre-orders are not allowed, however should you desire a custom order, feel free to email your name and specifications to orders@kayteko.co.za. Doing this does not constitute a valid sale and KayTeko reserves the right to accept or reject your request at our discretion. The following maximum time should be allowed for the garment to be shipped:

  • 14 business days for an order made for a garment directly through the KayTeko website.
  • 14 business days for a made-to-measure or custom order of a garment not sold on the KayTeko catalogue (this will vary depending on the complexity of the design and does not account for the time waiting for a fitting to be done by the customer should this be required).

KayTeko’s garments (sold directly on the website and all made-to-measure or custom garments) can only be purchased by and delivered to individuals residing within South Africa at the time of purchase unless an agreement has been reached with the customer in writing. KayTeko reserves the right to refuse service, terminate accounts and/or cancel orders if KayTeko believes that customer conduct violates this.

Once the item has been shipped and/or the item has been delivered to the physical address nominated by you, KayTeko will not be responsible for the delivery time to your nominated physical address as well as any loss, damage or unauthorised use of a product.

We will deliver your products to the address you provide us when placing your order. You are responsible for ensuring that the address is accurate and complete. We are not liable for any delay or failure in delivery due to incorrect or incomplete address information. We may contact you prior to organising delivery to confirm any details related to the order and/or delivery. Please ensure that the contact details (email address and contact number) and the nominated physical address are accurate. All courier services related to the return or replacement of the garment(s) will be made at the cost of the client.

All details related to the tracking of your parcel will be communicated to you through the courier service.

CHANGES TO THE ORDER AND APPOINTMENTS

The following section applies to only made-to-measure and custom garments.

The client will have the opportunity to attend a design consultation, mock-up fittings (max 2), fabric fittings (max 2) and a final fit upon collection (if in person). Additional fittings can be requested at an additional cost of R100 per additional fitting. Fittings will be arranged at the convenience of the studio and the client. Should the client need to cancel a fitting appointment they must inform the studio as soon as possible. A new fitting will be arranged, but any delay in the completion of the order due to a cancelled/postponed appointment by the client is not the fault of the studio though every effort will be made to complete the order by the agreed deadline.

The customer is advised to wear the underwear and shoes they intend to wear with the garments to ensure the correct fit. The studio takes no responsibility should the customer not do so, leading to the garment not fitting perfectly. In addition, no responsibility is taken for garments that do not fit correctly if the client’s body has changed (including but not limited to gaining and losing weight) between the final fitting and collection/delivery, or any other reason beyond the studios control.

At each fitting the client will sign their agreement to any choices or changes made to the design and fabrics. Should the client be unable to attend fittings, measurements must be agreed in writing and the studio will make the garments to the measurements provided. The studio takes no responsibility if the garment(s) do not fit when based on the measurements provided by the clients.

The cost of materials is approximate and is dependent on the choices made by the client and the availability of materials. The choice of materials will be made at the mock-up fitting and agreed in writing. Every effort will be made to obtain the fabrics and trims required by the customer. Should the exact fabric required be unavailable a suitable alternative will be sourced, on the agreement of the customer. Should the client wish to change the fabric or notions once it has been bought, the additional cost of the new fabric will be added to the final invoice. Note: that changes cannot be made once the fabric has been cut.

Design changes can be made at the mock-up fitting but once this design has been agreed changes are at the discretion of the studio. The hem length will be decided at the final fitting before completion. The client is advised to wear the shoes they wish to wear with the outfit at this fitting, as changes cannot be made once the hem length is agreed on. Upon collection the client will try on the garment to ensure the fit is correct. Any requests for minor alterations must be made known as soon as possible, as once the garment and final payment have been exchanged, any further work will come at an additional cost and be completed only when and if possible, this includes defects incurred as a result of ‘wear and tear’.

COMPLAINTS

If the customer is unhappy at any point they are advised to send us an email at customerservice@kayteko.co.za outlining their grievances as soon as possible. We will endeavour to resolve any problems within the parameters of the terms and conditions.

DIGITAL CONTENT

The customer is welcome to take digital content for personal use during fittings for made-to-measure or custom garments. Their use on social media sites must be agreed upon with the studio.

We reserve the right to use digital content taken during the construction process on the website https://kayteko.co.za as well as social media sites. This content shared online will include the customer if the customer agrees. KayTeko reserves the right to own all items including but not limited to all patterns, fabrics, notions, photographs and online content of custom order item(s). 

Once the garment has been completed, we will take a digital content for our records and portfolio both physical and online. The customer may be asked to have a photograph of them wearing the garment taken upon collection, or provide a photograph at a later date, for the studio’s records.

License

Unless otherwise stated, KayTeko and/or its licensors own the intellectual property rights for all material on KayTeko. All intellectual property rights are reserved. You may access this from KayTeko for your own personal use subjected to restrictions set in these terms and conditions. All content, trademarks and data on and included in our Website, including but not limited to text, graphics, logos, buttons, images, video, music, sounds, hyperlinks, databases, software, designs and agreements, as well as the assembly thereof, is the property of KayTeko or its content suppliers and is protected by South African and international copyright laws.

The following is not allowed through any means including but not limited to electronic, copying or recording:

  • Republish material from KayTeko
  • Sell, rent or sub-license material from KayTeko
  • Reproduce, duplicate or copy material from KayTeko
  • Redistribute content from KayTeko
  • Download, duplicate or display material from KayTeko

KayTeko reserves the right to refuse service, terminate accounts and/or cancel orders if KayTeko believes that customer conduct violates applicable law or is harmful to KayTeko’s interests.

Furtermore, these Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of South Africa.

We employ the use of cookies. By accessing KayTeko, you agreed to use cookies in agreement with the KayTeko’s Privacy Policy.

Most interactive websites use cookies to let us retrieve the user’s details for each visit. Cookies are used by our website to enable the functionality of certain areas to make it easier for people visiting our website.

Warranty Policy

By using our website, you hereby consent to our Privacy Policy and agree to its terms.

The products supplied by us shall be suitable only for the purpose designed and intended and you shall ensure the products are handled, stored and worn with in a reasonable manner or in a manner consistent with the instructions given upon purchase of the items. We shall not be liable for any action or claims for injury or damages of whatever nature arising from or in connection with the use of the products in breach of these Terms and Conditions.

Hyperlinking to our Content

The following organizations may link to our Website without prior written approval:

  • Government agencies;
  • Search engines;
  • News organizations;
  • Online directory distributors may link to our Website in the same manner as they hyperlink to the Websites of other listed businesses; and

Wait 2-3 weeks for a response.

No use of KayTeko’s logo or other artwork will be allowed for linking absent a trademark license agreement.

We shall not be hold responsible for any content that appears on your Website. You agree to protect and defend us against all claims that is rising on your Website.
